Why a 60-day Waiting Period?

Section 6.702 of the Texas Family Code was designed to give spouses time to reconcile after filing for divorce.  Spouses are able to use this time to attend mediation or counseling. Reconciliation is often possible outside of a courtroom.

Whether the 60-day waiting period is necessary has been widely debated.  While some argue that it is unnecessary, some claim that the waiting period needs to be extended to allow for more time to process.  Regardless of the ongoing deliberation, the 60-day waiting period is still required by law in the State of Texas.
